Feni's Madrassa student Nusrat Jahan Rafi has been sentenced to eight years rigorous imprisonment by the former OC Moazzem Hossain for filing a video.Bangladesh Cyber Tribunal judge Mohammad Asasam Jugalul Hossain on Thursday announced the verdict in the Digital Security Act.
State prosecutor Mohammad Nazrul Islam Shamim expressed his satisfaction over the verdict, but lawyer for the opposition Farooq Ahmed said they would appeal in the High Court.
Nusrat, an alim examiner of Sonagazi's Islamia Senior Fazil Madrasa, last March accused his principal Siraj-ud Daula of sexual harassment. The then OC Moazzem Hossain took his statement to the Sonagazi police station.
A few days after that, the head of the madrasa's aides opened fire on Nusrat, discussing the country. The video of Nusrat's statement spread on social media.
Syed Sayedul Haque Sumon filed a case at the Bangladesh Cyber Tribunal in Dhaka on April 5 after Nusrat died while undergoing treatment at the hospital.
Inspector Moazzem spread the video - based on a PBI report that began the trial four months ago.
Former OC Nusrat, a former OC of Sonagazi, who was standing in support of the case, admitted to the video but admitted that he did not knowingly commit any crime.
He told the judge on November 7, "We have received a bigger punishment than the one who was punished for this allegation."
A judge has sentenced Moazzem to seven years in prison for violating the Nusrat's statement under section 20 of the Digital Security Act. He was sentenced to three years imprisonment under section 26 for spreading the video over the Internet.
The police officer has to be sentenced to eight years in jail for the two-part punishment will be effective one after another. However, as per the rules during the stay, you will be excluded from the sentence.
Along with the imprisonment, he was fined Tk 500,000 in two sections. If he fails to pay that money, he will be sentenced to six months for a year.
The investigating officer of the case, Pima Senior Assistant Superintendent of Police, Rima Sultana, submitted an inquiry report on May 25, and issued a warrant for the trial judge against the accused, accused Moazzem.
OC Moazzem went to the High Court secretly on June 7 in an attempt to secure bail. But before the hearing, the police arrested him from Shahbag area.
After appearing at a cyber tribunal on June 5, the judge ordered the police officer to be sent to jail for failing to land. Later, on July 7, the court framed charges against the accused Moazzam and ordered the trial to begin.
The plaintiffs, including Barrister Sayedul Haque Sumon, Nusrat's mother, brother and two girlfriends, two policemen and investigating officers, testified in the case against the state. No defense witness was present in the case.
Feni's women and children's repression tribunal on October 25 sentenced eight people, including its principal Siraj-ud-daula, to death for killing Nusrat. That verdict has already gone to the High Court for hearing as a death reference.
